In order to prevent unauthorised access or disclosure of your information, we have put in place suitable physical, electronic and managerial procedures to safeguard what we collect online.

 

WE HATE SPAM. We're also not keen on newsletters, frankly, so if you signed up for our mailing list (thank you), expect to be disturbed about once a year! :) We will only include things we think are terribly exciting and relevant, and you may unsubscribe at any time.

 

PLEASE NOTE, the newsletter is separate from product and shipping updates. E.g. If there were a problem with your order, we would use your details to get in touch, but never assume permission to add those details to any marketing list.

However, once you have left our site, we of course do not have any control over that other website and cannot be responsible for the protection of any information which you provide whilst visiting such sites, and they are not governed by this privacy statement. Cancellation, Returns, Refunds & Exchanges

Summary

Please read this document carefully as the following terms and conditions constitute a legally binding contract. We’ll refer to ourselves as "we", "our", "us", etc. and the services available on the site as "the services".

1. Introduction

1.1 These terms and conditions are between you, the customer, and us, SUNGOLD'S EMPORIUM, on our website at https://www.sgemporium.co.uk/

 

1.2 Your use of this website and any service within constitutes acceptance of these rules in full. The Privacy Policy, above, is part of this agreement.

2. Customer Information

2.1 Please check that the information you provide to us is correct; a lot of problems can be avoided this way.

2.2 When we introduce customer accounts, you will be responsible for maintaining your username and password. Please ensure that you store your username and password securely and that the details required to access your account are not provided to another party.

 

2.3 As a customer you are responsible for your customer account and actions taken within it. If you are aware or suspect that your customer account username and password or other details have become known to a third party, you should inform us right away.

 

2.4 Our website is intended for use by adults. Adults may purchase products for children as long as the products purchased are intended by the manufacturer for use or consumption by children.

 

2.5 We reserve the right to restrict or remove your access to this website where you breach these terms and conditions. Such restriction or removal may take place without recourse or explanation where we deem it appropriate.

3. Privacy

3.1 We take your privacy seriously and have taken steps to comply with the GDPR (General Data Protection Regulation). For details, please see our Privacy Policy.

 

4. Product Pricing and Details

4.1 We make every effort to ensure that the product pricing and sundry information displayed on our website is correct and up-to-date.

 

4.2 If significant error is found, we may contact you to cancel your order, or contact you to arrange payment of any extra sum due to us, or, contrary-wise, to refund any over-payment made by you to us.

 

4.3 The processing of an order can generally be cancelled or corrected (by us) up to one working day after the order has been placed.

 

4.4 We reserve the right to alter product information without notice.

 

5. Your Order

5.1 When you place an order you will receive a confirmation email from us. 

 

5.2 Items not in the dispatch email are not in the order. (Ergo not in the contract between you and us).

 

5.3 We reserve the right to delay or refuse orders where a transaction contains incomplete details, or details that cannot be verified, or where fraud is suspected.

 

5.4 If we are unable to reasonably ascertain these details or resolve these issues, a full refund will be made against the card used at the time of purchase. No other form of refund or credit will be offered, nor will a refund be made to any third party card or account.

 

5.5 The risk of loss of, damage to and title for the goods will pass to you once we have been paid in full and when you (or a third party indicated by you) has acquired physical possession of the goods.

5.6 If carrier tracking indicates that a product was lost in transit, you may make a written claim for replacement of the lost product in compliance with our return policy. For products lost in transit, all claims must be submitted no later than 28 days after the estimated delivery date. All such claims are subject to investigation.

6. Shipping

6.1 All orders received by us are shipped subject to availability.

 

6.2 In the rare instance of a stock-level error, and you order something we don't currently have, we'll let you know and either pause the order until stock is back in, or refund you in full.

 

6.3 While we provide delivery estimates, we can't guarantee dates, or guarantee delivery to P.O. boxes. In any case, we will do our best to contact you and advise you of changes in order to make delivery as simple as possible.

 

6.4 We cannot be held responsible for disruption to shipping caused by industrial disputes or action outside our control. If such disruption occurs, you will be offered delivery via an alternate courier where possible, or a full refund.

 

6.5 In the rare instance you are ordering a product from us that is not already in this country, this will be made clear in the item's description, as customs duties may be owed.

N.B. Customs duties and tariffs are not levied on all imports, but if your order is eligible, you, the customer, would be responsible for paying, as per industry standard. You’ll be contacted by the courier company if so; they’ll send you a bill stating which fees you need to pay and may hold your parcel for three weeks. If you have not paid the bill by then, your parcel will be returned-to-sender. You shouldn't have to pay them to receive goods below the value of £135, unless they’re gifts over £39, or excise goods. Also, your order might be subject to delay, and/or be opened and searched by the authorities. We are unable to provide further advice on customs duties or tariffs, but a good place to read up is the UK government website: https://www.gov.uk/goods-sent-from-abroad.

7. Cancellation Rights, Returns, Refunds & Exchanges 

7.1 Under the current Consumer Contracts Regulations, you have the right to change your mind and cancel your purchase. To exercise this right, you must notify us in writing—email or letter—within 14 working days from the day after you receive your goods. It's nice to know what went wrong, but you don't have to give a reason. Please don't USE the goods if you invoke this, because...

7.2  Unless defective (and this is why you wish to return them) no right of return exists for:

  • used goods

  • opened goods that were sealed or shrink-wrapped

  • customised/personalised goods

  • goods that are intimate in their nature, or where there may be hygiene to consider (e.g. earrings, swimwear, face masks)

 

7.3 To help returns go as smoothly as possible, please observe the following:

  • Put your intentions in writing using the contact form. This legally covers your butt and ours.

  • Please do not send unwanted items to our Poole or London offices, as doing so will delay the processinstead, use the address on the shipping note, or email us to check where it should go.

  • With the returned item(s), on the back of your delivery note or on another piece of paper, quickly write your order number and the reason for the return.

  • Repackage the product in its original packaging, including any accessories, brochures, manuals, guarantees or warranties that came with the product, as we will be unable to issue a full refund where the product is in an incomplete state. If the packaging has been damaged, please make sure the item is well protected on its journey back to us! (Read on for who pays postage).

7.4 If your item arrived in an irreparable state, and you're certain it's not something better taken up with the courier, there's little point shipping it back to us, but multiple clear photographs must be sent of the damage in order to qualify for a refund or replacement. (It's a pain, we know, but blame the scammers out there. Also, sometimes we then need to convince the manufacturer that something needs looking at).

7.5 Speaking of, we want to give you a fair and reasonable shopping experience and hope you feel the same; we reserve the right to refuse business to bad-faith actors.

 

7.6 Initially, you are responsible for paying any postage or shipping costs incurred when returning a product, and we recommend that all returns be sent by registered post, or insured if expensive, so that a record of the return is available for you. (See 7.10 for when we reimburse you for this).

 

7.7 We will not issue refunds for any items lost or stolen in transit to us.

 

7.8 Where a return is lost or stolen in transit to us, you should claim compensation from the company that shipped the return.

7.9 Where we are convinced that no foul play has occurred, we will refund the purchase price of a returned product within 28 days of receiving written notification of your intention to return it.

 

7.10 Where the error was ours (e.g. we sent out the wrong item, wrong size, etc.) we will refund the cost of standard or recorded postage incurred by you when returning same. Please note that we cannot refund any courier, overnight or express element of any delivery or postage charge, including Royal Mail Special Delivery.

7.11 Exchanges: we generally prefer returns and full refunds over exchanges or partial refunds, but every case is different and we will endeavour to find whatever solution is most reasonable and fair to all parties.

 

8. Feedback & Complaints

8.1 We endeavour to respond to all customer complaints or queries within four working days.

 

8.2 We love your suggestions and ideas! They can help us improve your experience and our services. Just be aware that unsolicited ideas or other materials you submit to us are considered non-confidential and nonproprietary to you. By submitting those ideas and materials, you grant us a non-exclusive, worldwide, royalty-free, non-revocable, sub-licensable, perpetual license to use and publish those ideas and materials for any purpose, without compensation to you at any time.

 

9. Events Outside Our Control

9.1 We shall not be liable for delay or failure to perform any obligation under these Terms & Conditions if the delay or failure is caused by any circumstances beyond our reasonable control, including, but not limited to, natural disasters, war, civil disorder or industrial dispute.

 

10. Licence

10.1 We grant you a licence to access the content, information and services contained within our website for personal use only.

 

10.2 This licence allows you to download and cache (using your browser) individual pages from our website.

 

10.3 This licence does not allow you to download and modify individual pages or substantial parts of our website nor to make our website available via an intranet, where our website or a substantial part of it is hosted locally on the intranet in question.

 

10.4 Our website design, layout, content or text cannot be copied, edited or otherwise manipulated without our express prior written permission.

 

10.5 Our website cannot be placed within the frame-set of another site.

 

10.6 Third parties are not allowed to “deep link” to pages within our website, without our express prior written permission. All links (unless expressly permitted by us) should be to the main index page of our website. Furthermore, the content of such links, whether graphic or text should not be misleading, false, derogatory or in any other way offensive.

 

10.7 The restriction on “deep linking” does not apply to Ambassadors or partners who wish to send customers directly to a particular page or product in order to increase their affiliate sales.

 

11. Copyright

11.1 All content, databases, graphics, buttons, icons, logos, layouts and look & feel are our copyright, unless expressly acknowledged as otherwise.

 

11.2 The data mining, extraction or utilisation of product information from our website is not permitted without our express prior written permission.

 

12. User Generated Content

12.1 Where the facility exists you may provide reviews or public feedback on the website of products purchased by you, also known as user-generated content.

 

12.2 Where the facility exists such user-generated content can be provided in different formats and mediums; text, audio, video and still photographs.

 

12.3 As part of providing this content to us you agree to grant us a worldwide, irrevocable, non-exclusive and royalty-free license to use, distribute, edit, translate and repurpose such content, as we require, including sub-licensing to other parties.

 

12.4 Such content shall not infringe the intellectual property rights of any other party. Furthermore the content shall not be illegal or capable of breaching the laws of any jurisdiction in which it may be displayed.

 

12.5 We reserve the right to remove any content, which breaches or risks breaching these terms and conditions.

 

12.6 However, we shall not assume any responsibility for auditing or monitoring any user generated content.

 

12.7 Any complaints about such content by rights holders or any user or visitor to our website should be directed to us using our contact details listed at the end of these terms and conditions.

 

13. Limitations and Exclusions of Liability

13.1 Where content and information is provided on the website without charge we exclude all liability for such content and information.

 

13.2 All business losses (including, but not limited to) loss of profits, income, revenue, damage to goodwill, loss of other commercial contracts, other commercial opportunities are all excluded.

 

13.3 All indirect, consequential or special losses or damage are all excluded.

 

13.4 All other losses or damages not reasonably foreseeable at the time of the contract between you and us are also excluded.

 

13.5 All losses relating to the loss or corruption of data, databases, systems, software or hardware are all excluded.

 

13.6 These terms and conditions do not exclude or limit liability for death or personal injury caused by you or us.

 

13.7 These terms and conditions do not exclude or limit liability for fraud or fraudulent misrepresentation caused by you or us.

 

13.8 These terms and conditions do not exclude or limit liability where this conflicts with the applicable law for this jurisdiction.

 

14. Indemnity & Release

14.1 By your use of our website you hereby indemnify us and undertake to keep us indemnified at all times now and in the future against all possible claims relating to any breach of these terms and conditions by you. Such indemnities to include, (but not be limited to) all costs legal and otherwise, all other expenses, damages or settlements arising from your breach of these terms and conditions. 

 

14.2 To the fullest extent permitted by law you release us from any and all claims and demands, as well as any and all damages, losses, liabilities, judgments, costs, reasonable attorneys' fees, and other expenses incurred or suffered by us, of every kind and nature, known and unknown, relating to or arising out of any right, claim, or matter (a) which is disclaimed by us (or for which we provide no guarantees) under this agreement, or (b) for which Sungold's Emporium is otherwise indemnified or released by you under this agreement. We reserve the right to handle our legal defense however we see fit; you agree to cooperate with us.

 

15. Variation

15.1 We reserve the right to vary these terms & conditions at any time, without giving notice to you. Such varied terms and conditions shall automatically apply to the use of our website from the date of publication on our website.

 

16. Assignment

16.1 We reserve the right to assign our rights and also our obligations under these terms and conditions, without giving notice to you. This right of assignment shall only apply to us and shall not apply to you in any way.

 

17. Severability

17.1 The foregoing paragraphs, sub-paragraphs and clauses of these terms & conditions shall be read and construed independently of each other. Should any part of this agreement or its paragraphs, sub-paragraphs or clauses be found invalid it shall not affect the remaining paragraphs, sub-paragraphs and clauses.

 

18. Waiver

18.1 Failure by us to enforce any accrued rights under these terms & conditions is not to be taken as or deemed to be a waiver of those rights by us unless we acknowledge the waiver in writing.

 

19. Third Parties

19.1 These terms and conditions are between you and us. They do not apply to, or benefit any third party and are not reliant on any third party.

 

20. Entire Terms & Conditions

20.1 These terms & conditions set out the entire agreement and understanding between you and us.

 

21. Your Statutory Rights

21.1 Where acting as a consumer your statutory rights are unaffected.

 

22. Jurisdiction

22.1 These terms & conditions shall be interpreted, construed and enforced in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts.
